I have few photos rejected because of the possible copyright issue.
"Problematic" part are 2 (two) parallel stripes on the girls pants.
When I asked why they rejected this photos answer was:
"The copyright issue refers, indeed, to the parallel stripes which are Adidas trademark.
Please note that the Adidas trademark topic refers to 2,3 and 4 parallel stripes, having the same color."
I can't beleave this is true for 2 and 4 stripes!?
Looked at the Adidas site and all over the internet and can't find any information about 2 and 4 stripes, only 3. |

You can read more about the adidas trademark here. It does apply to even 2 and 4 stripes. adidas copyright |

Can you really copyright stripes? Obviously if they are part of a logo, in conjunction with other elements like a brand name or symbol, then fine... but stripes on their own, regardless of how many, are just stripes aren't they?
Some centre of the road markings consist of three stripes...

I'm fairly sure Adidas don't get royalties from the Highways Agency for using three stripes on the road!

funny :) the trademark only applies to shoes and clothing so not to worry about ALL 2, 3 and 4 instances of lines ;) |

I checked out that article you listed and it appears to be from 2003 while the link I provided is from a case in April 2006 so it is the most up to date info on the stripe trademark.
I understand your frustration, I shoot some sports and have to clone out sooo many logos including those stripes. I did not see your images but perhaps you could remove the stripes from your images and resubmit.

This sounds like the Intel story where they were suing almost anybody having the letters e,i,l,n,t in their name. They had a lengthy case with a company called Intel Transportation (or so) established some 30 years ago when Intel wasn't as big as today and that had absolutely nothing to do with computers or chips. But those little guys just wanted to keep their name as they were doing nothing wrong. I didn't follow the story so I have no idea how it ended.
IP is such a slippery terrain, you can't blame DT for playing safe. |

On the other micro stock site which is much more "paranoid" about copyright I got confirmation from one of the inspectors that two stripes is not Adidas trade mark and those photos would be accepted without problem. |

We refuse images based on copyright/trademark infringement potential not only when the infringement is obvious.
This is done in order to ensure we avoid potential hassle and discussions later. The fact we license so many images adds the fact that we need to be careful on "potential" issues too. Otherwise we can be swamped in legal or intelectual property discussions with claimed-to-be infringed party, buyers who use the image or the photographer who took it.
Furthermore, in regards to the specifics of the stripes, we consider these images to be less generic. A buyer who downloads them for an advertisement of his store might see better results if the stripes are not there. Maybe he carries Nike but not Adidas.
And a last note to Gizmo: if you have been given an explanation from the editor, why do you think discussing a refusal on the board will help? Please ask the editor in the future, don't bring refusals on the boards.

thank you for your brief explanation.
I know that is a rule not to discuss about rejected images on forum, but I didn't posted them here crying to accept them. I just wanted to be sure for future uploads because this "2,3 and 4 stripes" rule exist only here at DT. |

I had the same problem with stripes, too. I still don't catch some small things but I didn't ask what the problem was and it took me a while to figure out the stripes were the problem! I told my friend she was banned from wearing those again when we go out on a hike, either that or she just has to remove them and that may sell even MORE pictures-HMMMMMM

Wow! Thanks for that link Kathy and thanks for bringing it up Dragan. I had no idea about the stripes and the potential.
I was doing some research earlier in the year and found something similar...I guess the color blue, when it comes to ice fishing shelters and related ice fishing clothing is trademarked by the Clam Corporation. I was very surprised (just as surprised as I am about the stripes!). |
